Cachar POCSO Court Sentenced Five Years Jail to Two Men for Molesting a minor girl

In a significant Judgement, Cachar POCSO court has sentenced five years jail to two men for molesting a minor girl in a moving auto. The verdict was delivered by Judge Narayan Kuri on July 17. The two accused men are Didarul Islam age 40 of Tarinipur Part-2 and other is Bahar Uddin Raj Barbhuiya age 35 of West Gobindapur Part-3, under Katigorah Police Station.

The incident has took place on September 10, 2017, when a 17 years old girl has boarded an auto from Chourangi, Katigorah around 10 am to visit a relative in Fulbari. The driver was Didarul, while Bahar Uddin was accompanying him. During the ride, the duo began harassing the girl inside the auto near Gobindapur ME School.

When the victim girl raised an alarm, they reportedly threatened her and even pushed her out from the moving auto. The girl then managed to run to a nearby house for safety. This two men then fled from the scene.

Following the incident the victim girl’s family went to the police station and lodged an FIR at Katigorah Police Station. The police launched an investigation and identified the accused. After the investigation completed the case brought to trial.

On Thursday, the Cachar court found the two men guilty and Under Section 8 of the Protection of Children from Sexual offences (POCSO) act and sentenced them to five years of imprisonment each and also Rs.20,000 fine. If in case of default of the fine, they will have to serve an additional six month in jail.

Additionally, they were convicted under Sections 506/34 of the Indian Penal Code for criminal intimidation and common intention. For this, they received another six-month sentence and a fine of ₹1,000. Non-payment of this fine would result in one more month of imprisonment. All sentences will run concurrently.
