The Supreme Court has emphasized that sex education should be introduced to children at a much earlier age rather than waiting until Class 9. A bench comprising Justices Sanjay Kumar and Alok Aradhe highlighted the importance of educating students about the physical and emotional changes that occur during puberty at a young age. They stated during a hearing of a case that such early awareness can help children navigate adolescence more responsibly and with better understanding.

The court noted that early sex education promotes healthy attitudes, responsible behavior, and informed decision-making among young people. Bench stated, “However, we are of the opinion that sex education should be provided to the children from a younger age and not class IX onwards. It is for the authorities concerned to apply their mind and take corrective measures, so that children are informed of the changes that happen after puberty and the care and cautions to be taken in relation thereto.”

These Court has remaks the context while hearing of a case involving a 15-year-old boy who had appealed against the Allahabad High Court’s refusal to grant him bail in a serious case. The boy was accused of serious offences involving Sections 376 (rape) and 506 (criminal intimidation) of the Indian Penal Code, as well as Section 6 of the Protection of Children from Sexual Offences (POCSO) Act. Since the accused is a minor, so, the Supreme Court had granted him bail in September with conditions set by the Juvenile Justice Board.

Furthermore, the Supreme Court also directed the Uttar Pradesh government to submit a detailed affidavit on how sex education is currently provided in higher secondary schools. This move aims to review existing practices and encourage more effective, age-appropriate sex education.
